Arbitration and Conciliation

IIndia’s governing arbitration statute is the Indian Arbitration and Conciliation Act, 1996. It is based on the United Nations Commission on International Trade Law’s (UNCITRAL) Model Law on International Commercial Arbitration, which was adopted in 1985.

The Arbitration and Conciliation Act’s objectives are to:

• Cover both international and domestic arbitration and conciliation
• Make provisions for an arbitral procedure that is fair, efficient, and capable of meeting the needs of the arbitration
• Allow an arbitral tribunal to use mediation and conciliation to encourage dispute settlement
• To provide that a settlement reached by the parties as a result of conciliation proceedings will have the same status and effect as a settlement reached by the parties as a result of conciliation proceedings. To ensure that every arbitral ruling is enforced in the same way that a court order would be.
